1. Agreement to Terms

By accessing or using SMSFNF ("the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you do not have permission to access the Service. These Terms apply to all users, including visitors, registered users, and API consumers.

2. Description of Service

SMSFNF provides an SMS gateway service that allows you to:

• View and manage SMS messages received on registered phone numbers
• Send SMS messages through our gateway
• Forward incoming SMS messages to Discord webhooks or custom URLs
• Access SMS data programmatically through our API
• Manage multiple phone numbers (SIMs) under one account

3. Account Registration

• You must provide a valid email address and create a secure password
• You must verify your email address before accessing full features
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account
• One person or legal entity may not maintain more than one account
• You must be at least 18 years old to create an account

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Send spam, unsolicited bulk messages, or marketing messages without consent
• Engage in phishing, fraud, or any illegal activities
• Harass, threaten, or abuse any person or entity
• Transmit malware, viruses, or malicious code
• Violate any applicable local, state, national, or international laws
• Impersonate any person, business, or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any purpose that violates carrier terms of service
• Send messages containing illegal content or promoting illegal activities

5. API Usage

• API access is provided through your unique API key
• You must not share your API key with unauthorized parties
• API usage is subject to rate limits to ensure fair access for all users
• Excessive or abusive API usage may result in temporary or permanent suspension
• We reserve the right to modify API endpoints and functionality with notice
• You are responsible for all activity that occurs using your API key

6. Discord Integration

When using Discord webhook integration, you acknowledge that message data will be transmitted to Discord's servers. You are responsible for ensuring your use of Discord webhooks complies with Discord's Terms of Service. We are not responsible for any actions taken by Discord regarding your webhook or account.

7. Phone Numbers & SIMs

• Phone numbers are assigned based on availability and your subscription
• You must only use phone numbers that are legitimately assigned to your account
• Phone number availability and functionality depend on our carrier partners
• We reserve the right to reassign or remove phone numbers for policy violations

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We may modify, suspend, or discontinue any part of the Service at any time with or without notice.

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by SMSFNF and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

IN NO EVENT SHALL SMSFNF, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless SMSFNF and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or violation of any rights of a third party.

13. Account Termination

We may terminate or suspend your account immediately, without prior notice, if:

• You violate these Terms and Conditions
• You engage in fraudulent or illegal activity
• You abuse the Service or other users
• Required by law or regulatory authority

Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through appropriate legal channels.
